Sales Conditions

These Sales Conditions (“Sales Conditions”) set out the terms applicable to transactions made through the Blisterr platform (peeks, lives, auctions, Drops, giveaways, instant buy). They supplement the Terms of Service (the “Terms”) and the Code of Ethics. Definitions used here are those of article 2 of the Terms. All prices are in euros.

1. Purpose and scope

These Sales Conditions govern the sale of items between buyers and sellers (private or professional) through the Blisterr platform, whatever the sale format: instant buy, standard auction, silent auction, Drop, giveaway, in a peek or in a live.

Blisterr SAS acts as an online platform operator within the meaning of article L.111-7 of the French Consumer Code and as a technical intermediary. Blisterr is neither the seller nor the buyer of the items. It provides the buyer with a matching, secure payment and buyer protection service, the fees for which are described in article 6.

2. Parties and seller status

  • Private seller: an adult user occasionally selling personal items, not acting in a professional capacity.
  • Professional seller: a user acting in the course of their commercial, craft, professional or agricultural activity. They identify themselves as such in their application and provide their legal information (company name, SIRET, legal form, VAT regime).
  • Buyer: an adult user making a purchase. They are a consumer when acting for purposes outside their professional activity.
  • Blisterr: platform operator. Card payments are collected by Stripe, the payment provider.

The seller’s status (professional or private) is declared in their application. A professional seller is identified as such on the public page of their shop (“Pro” badge, explained as “Professional seller” on hover or tap); a shop without this label is run by a private seller. This status determines the rules that apply to the buyer, in particular the right of withdrawal (article 8) and the statutory warranties (article 9.1). Each seller chooses the status that matches their situation: regular, profit-making activity falls under professional status, and Blisterr may request supporting documents. The parties’ civil and tax rights and obligations are summarised in article 16 of the Terms.

3. Listings and offers

Sellers are responsible for the content of their peeks, lives and product pages: title, description, photos, videos, declared condition, price, shipping fees and special conditions. The information must be accurate, complete, up to date and lawful. The professional seller must also provide the consumer buyer with the pre-contractual information required by the Consumer Code.

Listing an item constitutes a firm offer at the stated conditions. The seller undertakes to honour the sale if a buyer buys at the listed price, wins an auction or is the first to click Buy in a Drop.

4. Sale formats

4.1 Peeks

A peek is a short vertical video presenting a catalogue item. The item can be offered as an instant buy, an auction (standard or silent), a Drop or a giveaway. The duration of a peek auction is set by the seller; it ends at the displayed time.

4.2 Lives

A live is an interactive live broadcast during which the seller presents and sells items one by one. The sale format of each item (auction, instant buy, Drop, giveaway) is chosen by the seller. A live lasts two hours at most.

4.3 Instant buy

The price is fixed: you buy at the displayed amount, expressed in whole euros.

4.4 Standard auction and silent auction

  • Standard auction: the price goes up, bids are visible to everyone, and the highest bid at closing wins.
  • Silent auction: bids are hidden until closing, and the best bid wins.

The minimum increment is €1 up to €99, then €3 from €100. The bidder can set an automatic bid up to a maximum amount they choose. No bid may exceed €100,000.

In a live, a bid placed with less than 15 seconds left resets the countdown to 15 seconds, up to a limit of one hour per item; the seller can disable this extension. Peek auctions end at the displayed time, with no extension.

Every bid placed is a firm, final and irrevocable commitment to pay once it is won. The bidder may not withdraw their participation, except for an obvious technical error by the platform. This principle does not deprive the consumer buyer of the right of withdrawal provided for in article 8 when the seller is a professional; when the seller is a private individual, no right of withdrawal applies and a won auction is a firm commitment.

4.5 Drop

A Drop is a descending-price sale (Dutch auction). The seller sets a starting price, a floor price (€1 by default) and a duration; in a live, the duration of a Drop is between 10 and 60 seconds. The price drops automatically and linearly, in whole euros. The first buyer to click Buy wins the item at the price displayed at that moment.

4.6 Giveaway

A giveaway is a free prize draw among eligible participants. It is governed by the rules in annex 3 of the Terms. The winner pays neither the item, nor the buyer protection fee, nor delivery, which is borne by the seller.

Blisterr’s auction service is an online auction brokerage service carried out remotely by electronic means within the meaning of article L.321-3 of the French Commercial Code. It is not a public auction sale: Blisterr does not act as a court officer or a voluntary sales operator, does not award items and does not intervene in the description of items or in the conclusion of the sale, which is concluded directly between the seller and the buyer.

4.8 Payment deadline for a won auction

Every won auction must be paid for within 4 days:

  • for a peek, within 4 days of the win;
  • for a live, payment is made automatically at the end of the sale, using your wallet and, if applicable, your default card. If it fails (3D Secure authentication, bank refusal), you have 4 days to put it right.

If payment is not made within this period, the item is put back on sale and a strike is added to your account. A strike limits your auctions (standard and silent) to your wallet balance for 6 months; the balance must cover the bid, the buyer protection fee and delivery. Your card purchases (instant buy, Drop) remain possible. The strike expires automatically after 6 months. In case of repeated or serious breaches, Blisterr may take the measures provided for in article 24 of the Terms.

An order created at payment but not paid within 30 minutes is cancelled.

5. Conclusion of the sale

The sale is concluded between the seller and the buyer when the buyer confirms their purchase (instant buy, Drop) or wins the auction at closing. A confirmation email is sent to the buyer and a notification to the seller. The seller then undertakes to ship the item.

To buy, the buyer must have a complete profile (first name, surname, date of birth), at least one delivery address and a card payment method. In a live, a default pickup point is also required.

6. Price, payment and fees

6.1 Price

Prices are expressed in euros. They include taxes when the seller is a VAT-registered professional; private sellers do not charge VAT. Depending on the screen, the displayed price may include the buyer protection fee; the exact amount to pay, fees and delivery included, is always shown at the payment step, before confirmation.

6.2 Payment methods: through Blisterr only

The buyer can pay by:

  • bank card (Visa, Mastercard, American Express depending on availability);
  • Apple Pay and Google Pay;
  • Blisterr wallet balance (if available), on its own or together with a card payment. A card payment is possible from €0.50.

Card payments are processed by Stripe Payments Europe, Ltd. (Ireland). Blisterr stores no banking data.

Any other payment method is strictly prohibited. In particular: direct bank transfer, PayPal, cash, cryptocurrencies, external Stripe link, and more generally any payment made outside the platform’s built-in channels. This prohibition applies to sellers and buyers and covers every transaction initiated through Blisterr.

Only payments made through Blisterr qualify for buyer protection. Any violation may lead to account suspension and exclusion from the buyer protection programme.

Abusive or fraudulent chargebacks (a bank dispute when the item was received as described) may lead to account suspension and to recovery action by Blisterr.

6.3 Fees

  • Buyer protection fee: 6.9% of the item price (shipping excluded) + €0.49 charged only once per order with the same seller, and only once for a whole live session. Example: a €50 item gives €3.45 + €0.49 = €3.94, i.e. €53.94 before shipping. No protection fee is due for a giveaway.
  • Seller: 0% commission and no listing fees. The seller receives the sale price of the item.
  • Delivery: borne by the buyer, calculated according to the chosen method and destination (except for a giveaway, article 4.6).
  • Wallet withdrawal (seller): 1 free withdrawal every 40 days, then 3% + €1 per additional withdrawal. The minimum withdrawal is €1.

The fee schedule may change. Any change is communicated at least 15 days in advance and does not apply to orders already placed.

6.4 Wallet and refunds

The wallet is a Blisterr balance, kept in a ledger that records the amounts owed to you (sale proceeds, refunds, referral credits, credits granted by the team) and those used for your payments. It is not a bank account, does not earn interest and is not subject to any inactivity or account-keeping fees. It cannot be topped up. Stripe only intervenes when card payments are collected and for withdrawals.

Refund. When a refund is due to the buyer (withdrawal, buyer protection, cancellation), it is credited to their wallet. The buyer can then use this balance for their next purchases or withdraw free of charge, from the wallet withdrawal screen, the amounts they paid themselves by card and have not used: these are then refunded to the original payment method, within the timing shown in the app when you withdraw (5 to 10 business days). Referral credits cannot be withdrawn.

Buyer’s express agreement. By accepting these Sales Conditions, the consumer buyer gives their express agreement to this refund method by credit to the wallet (article L.221-24 of the French Consumer Code). They keep the right, at any time, to ask for the eligible amounts to be withdrawn to their original card, as described above.

6.5 Sale proceeds

The sale price is credited to the seller’s wallet no later than 20 days after delivery, a safety period set by Blisterr. The seller can then request a withdrawal to their bank account via Stripe Connect (estimated timing shown in the app, 2 to 3 business days). Stripe identity verification is carried out during the seller application. The seller’s debts to Blisterr (giveaway delivery, lost dispute, customer refund) are deducted automatically from their next payouts or withdrawals.

6.6 Invoicing

The professional seller is responsible for issuing their invoices in accordance with applicable regulations. In their application, they accept an invoicing mandate authorising Blisterr to issue invoices in their name; Blisterr provides the transaction details needed for invoicing and, where applicable, electronic invoices generated through its e-invoicing partner. The buyer protection fees are invoiced by Blisterr to the buyer.

7. Purchase, delivery and order grouping

7.1 Order grouping

Purchases made in a live from the same shop are grouped in a single parcel for 24 hours from the first purchase: shipping is calculated on the combined parcel and the €0.49 flat fee is charged only once.

7.2 Delivery methods and countries

Blisterr offers the carriers Colissimo (La Poste) and Mondial Relay, as well as Chronopost when the seller has enabled it. In a live, delivery is to a pickup point, the buyer’s default pickup point. Labels are generated via Sendcloud.

Delivery is available to mainland France, Belgium, Luxembourg, Switzerland and the French overseas departments (Réunion, Martinique, Guadeloupe, French Guiana). Sellers ship from France.

7.3 Shipping and delivery times

The seller ships the item within a reasonable time and, where applicable, within the time stated in their listing. When the seller is a professional, they deliver no later than 30 days after the contract is concluded, unless a date is agreed (article L.216-1 of the French Consumer Code); in case of delay, the consumer buyer can exercise the remedies of articles L.216-2 and L.216-3. If the item is not shipped, the buyer can request cancellation and a refund by contacting the seller and then, if necessary, Blisterr support.

7.4 Shipping costs

Shipping costs are calculated according to the stated weight and the destination. Any obvious discrepancy between the declared weight and the actual weight may be corrected.

7.5 Transfer of risk

In sales between a professional seller and a consumer, the risk of loss or damage to the item passes to the consumer on delivery (article L.216-4 of the French Consumer Code). In sales between private individuals, the rules of the Civil Code apply between seller and buyer, without prejudice to Blisterr buyer protection (article 9.2).

7.6 Tracking

Order tracking is available from Menu > Orders.

8. Right of withdrawal

8.1 Sale by a professional to a consumer

When the seller is a professional and the buyer a consumer, the buyer has a 14-day period from receipt of the item to exercise their right of withdrawal, without having to give a reason (articles L.221-18 et seq. of the French Consumer Code), subject to the exceptions in article 8.3, in particular for items opened in a live (article 8.4).

If the seller did not inform you of this right, the period is extended by up to 12 months (article L.221-20).

How to withdraw. The app has no withdrawal button: withdrawal goes through Blisterr’s customer service. Before the period expires, notify your decision, stating your order number, by one of the following means:

  • by email to support@blisterr.com;
  • through the site’s contact form;
  • through the app’s messaging, from your order details (the “Contact the seller” button).

You may use the model form in the annex, but you are not required to: any statement setting out unambiguously your decision to withdraw is enough. Blisterr’s customer service records your request on the seller’s behalf and confirms it to you by email. Blisterr then processes the order cancellation and the refund from its administration tool; the seller is informed of your decision.

Return and refund. You return the item no later than 14 days after notifying your withdrawal, in the condition in which you received it. The direct cost of returning it is borne by you, unless the seller agrees to bear it or did not inform you, before the purchase, that it is borne by you. You are liable only for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the item (article L.221-23). The price and the initial delivery costs (cheapest standard delivery offered) are refunded no later than 14 days after the seller is informed of your decision; the refund may be deferred until the item is recovered or proof of its dispatch is provided. It is made under article 6.4: credit to your wallet, with the option to withdraw free of charge to your original card for the part you paid by card.

8.2 Sale between private individuals

The right of withdrawal provided for by the Consumer Code does not apply to sales between private individuals. The Blisterr buyer protection programme (article 9.2) still applies.

8.3 Exceptions

The right of withdrawal cannot be exercised in the cases set out in article L.221-28 of the French Consumer Code. In Blisterr’s activity, these are mainly:

  • items opened during a live at the buyer’s request (box breaks, booster openings), under the conditions of article 8.4;
  • items made to the buyer’s specifications or clearly personalised.

8.4 Openings in a live (box breaks, booster openings)

During a live, the seller may offer a sealed item with random content (booster, display, box set, mystery box, spot in a box break) whose opening on stream is part of the offer. The seller states this clearly before the purchase. In that case:

  • by bidding or buying, the buyer expressly requests that the opening take place immediately during the live and acknowledges losing their right of withdrawal once the opening has taken place (article L.221-28, 1°, of the French Consumer Code);
  • the opening takes place on stream, on the buyer’s behalf, before any shipment: the item can no longer be returned in the condition in which it was sold, and the buyer receives the revealed contents;
  • the randomness of the contents does not give rise to any refund.

A sealed item bought in a live without an on-stream opening remains subject to article 8.1. The buyer protection programme covers the cases described in article 9.2 (repackaged pack, proven counterfeit, item damaged before opening), and the statutory warranty of conformity still applies.

8.5 Blisterr service

The buyer protection fees pay for Blisterr’s secure payment and buyer protection service. If you withdraw from the purchase, this ancillary service ends and the buyer protection fees for the order concerned are refunded (article L.221-27). They are also refunded if the order is cancelled before shipment or if the order is fully refunded under buyer protection.

9. Warranties and buyer protection

9.1 Statutory warranties

When the seller is a professional, the consumer buyer benefits from the statutory warranty of conformity, lasting two years from delivery of the item (articles L.217-3 et seq. of the French Consumer Code). The warranty against hidden defects (articles 1641 et seq. of the French Civil Code, action to be brought within two years of discovering the defect) benefits every buyer, whether the seller is a professional or a private individual.

9.2 Blisterr buyer protection

Blisterr offers a buyer protection programme that applies to sales by private and professional sellers alike, in case of an item not received, damaged, substantially different from its description or proven counterfeit. It can be used within 30 days of receiving the item (or of the expected delivery date if it is not received). It is in addition to the buyer’s statutory rights and does not replace them.

Procedure:

  1. From your order details, use “Contact the seller” to explain the problem to them.
  2. If the seller does not help, contact our team at support@blisterr.com (or on Discord) with photos and supporting documents.
  3. Blisterr reviews your case, may ask both parties for supporting documents and decides on a full or partial refund, or rejection. If a refund is decided, it is credited to your wallet (article 6.4).

The seller is paid only after delivery and a safety period (article 6.5). In case of a refund, Blisterr recovers the seller’s share by deducting it from their scheduled payout, their wallet or their next payouts.

10. Disputes between users

Users are invited to favour amicable resolution through the platform’s messaging. If the disagreement persists, the buyer can use buyer protection (article 9.2). Blisterr’s decisions in this matter are notified by email and reasoned. They do not deprive any party of the right to go to a mediator or a court.

11. Consumer mediation and jurisdiction

In accordance with articles L.611-1 et seq. of the French Consumer Code, every consumer has the right to use a consumer mediator, free of charge, to seek an amicable resolution of a dispute with Blisterr, after a prior written complaint to support@blisterr.com.

For a purchase from a professional seller, the consumer may use the mediator designated by that seller, whose details must be given to them.

These Sales Conditions are governed by French law, without depriving the consumer of the protection afforded by the mandatory provisions of their country of habitual residence. In case of dispute, the consumer may bring proceedings, at their choice, before the courts of the place where they live or of the place of delivery. For disputes between professionals, the courts of Bayonne have jurisdiction.

12. Penalties

In case of breach of these Sales Conditions, Blisterr may impose the measures listed in article 24 of the Terms (content removal, payment restriction, suspension, termination, cooperation with the authorities), under the conditions of reasoning and appeal provided there.

These Sales Conditions are written in French. The English translation is provided for information only; the French version is the only authoritative one.
