Terms of Service

1. Purpose

These Terms of Service (“Terms”) set out the conditions and procedures for accessing the Blisterr website and application, as well as the rules applicable to the use of the services offered (the “Services”).

Blisterr enables users to buy and sell items through peeks (product videos) and lives (interactive live sales), in five sale formats: instant buy, standard auction, silent auction, Drop and giveaway.

2. Definitions

“Blisterr” or “the Provider”: the company BLISTERR, a French SAS with share capital of €1,000, registered with the Bayonne trade register (RCS Bayonne) under number 918 924 556, with registered office at 3 rue Denis Etcheverry, 64100 Bayonne, France.

“Site” or “App”: the web and mobile interfaces accessible via https://blisterr.com and the associated application.

“User”: any person accessing the Site or the App, whether buyer, seller or visitor.

“Buyer”: a user who purchases an item from a seller.

“Seller”: a natural or legal person, professional or private, operating a shop on Blisterr.

“Shop”: the personal space where a seller publishes and manages their peeks and lives.

“Peek”: a short video presenting an item, which can be offered for direct sale, in an auction (standard or silent), as a Drop or as a giveaway.

“Live”: an interactive live broadcast during which a seller presents and sells items in real time.

“Item”: any good or product offered for sale on the platform.

“Drop”: a descending-price sale (Dutch auction) in which the first buyer to click Buy wins the item.

“Giveaway”: a free prize draw for an item among eligible participants.

“Wallet”: a Blisterr balance, kept in a ledger, which records the amounts owed to the user and those the user spends on payments (article 9.3).

“Strike”: a measure applied to a buyer who does not pay for a won auction on time (article 11.4).

“Payment provider”: Stripe, which collects card payments and operates sellers’ Stripe Connect accounts.

“Hosts”: the providers that host the Site, the data and the media, identified in the Legal Notice.

“Code of Ethics”: the document defining best practices on Blisterr.

“Privacy Policy”: the document describing the collection and processing of personal data.

“Applicable Regulations”: all French and European laws, including the Civil Code, the Consumer Code, the GDPR, the French Data Protection Act and Regulation (EU) 2022/2065 on digital services (the “DSA”).

3. Acceptance

Access to and use of Blisterr require full acceptance of these Terms.

Acceptance is given when the account is created by ticking the appropriate box.

These Terms are accessible at any time via a link at the bottom of every page of the Site or in the App. They are written in French (article 30).

4. Contractual hierarchy

In case of contradiction between these Terms and any other document or page of the Site, these Terms prevail. The specific policies (Code of Ethics, Privacy Policy, Sales Conditions, etc.) supplement these Terms.

5. Amendments to the Terms

Blisterr may amend these Terms, in particular to reflect changes to the Services or to the regulations.

Any substantial amendment is notified to Users by email or by notification in the App at least 15 days before it takes effect. The effective date appears at the top of each document. During this period, a User who rejects the amendment may close their account free of charge; use of the Services after the effective date constitutes acceptance.

Amendments required by law or by a decision of an authority, and those that do not affect Users’ rights, may apply immediately. Professional sellers also benefit from the provisions of article 20.

Blisterr provides an intermediation platform between buyers and sellers: it is an online platform operator within the meaning of article L.111-7 of the French Consumer Code and an intermediary service provider within the meaning of the DSA.

It offers tools for presentation (peeks, lives), messaging, payment and moderation.

The auction service is an online auction brokerage service carried out remotely by electronic means within the meaning of article L.321-3 of the French Commercial Code. It is not a public auction sale: Blisterr does not award items and does not intervene in the description of items or in the conclusion of the sale, which is concluded directly between the seller and the buyer.

Blisterr is not the seller of the items: the seller is responsible for their description, conformity, authenticity and condition. Blisterr’s role is to facilitate transactions, secure payments, handle buyer protection requests (article 9.2 of the Sales Conditions) and moderate content.

7. Account creation

Registration is free and reserved for adults (18 years or older). By accepting these Terms when creating their account, the User declares that they are at least 18. Blisterr does not knowingly collect data from minors; it reserves the right to request any supporting document and to delete an account whose holder is a minor or made a false declaration.

The information required includes: surname, first name, email and date of birth. To buy, the buyer must have a complete profile, at least one delivery address and a card payment method (for lives, a default pickup point).

Opening a shop is subject to an application, reviewed manually by the Blisterr team, with no guaranteed turnaround time. The seller must be 18 or older and sell from France. The application includes the status (private or professional, with SIRET, legal form and VAT regime for a professional), the categories sold, social network links, an introduction video and identity verification carried out by Stripe.

Account access uses a secure login code sent by email or SMS.

The User is solely responsible for the confidentiality of their access credentials and for any activity linked to their account.

8. Access and availability

The Services are accessible 24/7, except for interruptions for maintenance, security or force majeure. Blisterr endeavours to limit the duration of such interruptions, without prejudice to the rights the User holds under the law.

The User must have an up-to-date and secure technical environment.

9. Fees, payments and wallet

9.1 Fees

  • Buyer: buyer protection fee of 6.9% of the item price (shipping excluded) + €0.49 charged only once per order with the same seller, and only once for a whole live session. No protection fee is due for a giveaway.
  • Seller: 0% commission and no listing fees. The seller receives the sale price of the item.

The fee schedule may change, with 15 days’ notice, with no effect on orders already placed.

9.2 Payments

Card payments are collected by Stripe, the payment provider supplying the secure infrastructure. No banking data is stored by or accessible to Blisterr.

9.3 Wallet

The wallet is a Blisterr balance, kept in a ledger. It records the amounts due to the user (sale proceeds, refunds, referral credits, credits granted by the team) and those the user spends on payments. It is not a bank account, does not earn interest and is not subject to any inactivity or account-keeping fees. It cannot be topped up. It can be used on its own or together with a card payment (minimum of €0.50 for a card payment).

Card payments, card refunds and transfers to sellers’ bank accounts are carried out by Stripe; Blisterr only keeps the wallet ledger. Amounts from referrals cannot be withdrawn.

9.4 Payment of sale proceeds

The sale price is credited to the seller’s wallet no later than 20 days after delivery, a safety period set by Blisterr. If the buyer is refunded, Blisterr recovers the seller’s share by deducting it from their scheduled payout, their wallet or their future payouts.

9.5 Withdrawals

  • Sellers: withdrawal from the wallet to the shop’s Stripe Connect account and then to the bank. 1 free withdrawal every 40 days, then 3% + €1 for each additional withdrawal in the same window; minimum €1 per withdrawal. The estimated timing is shown in the app when you withdraw (2 to 3 business days). Seller debts are deducted before fees are calculated.
  • Buyers: amounts the buyer has paid by card and has not used can be withdrawn free of charge to the original payment method (timing shown in the app: 5 to 10 business days). This withdrawal is not a bank transfer; referral credits are not eligible.

Stripe identity verification is carried out during the seller application.

9.6 Seller debts

The following are automatically deducted from the seller’s next payouts or withdrawals: delivery costs of a giveaway, amounts from a lost dispute (chargeback) and refunds owed to a customer.

10. Purchase, delivery and order grouping

Purchases can be made from peeks or lives.

Purchases from the same shop may be grouped; in a live, grouping is automatic for 24 hours from the first purchase.

Shipping costs are calculated according to the stated weight; any obvious discrepancy may be corrected.

Tracking is available from Menu > Orders.

The carriers offered are Colissimo (La Poste) and Mondial Relay, as well as Chronopost when the seller has enabled it. Delivery is available to mainland France, Belgium, Luxembourg, Switzerland and the French overseas departments.

The full terms (delivery methods, timing, transfer of risk, right of withdrawal, warranties, buyer protection, disputes) are set out in the Sales Conditions.

11. Sale formats

11.1 Auctions

Two auction formats: standard (bids visible) and silent (bids hidden until closing). At closing, the sale is concluded directly between the seller and the bidder whose bid is highest, according to the rules of the format chosen by the seller. The detailed rules (increments, automatic bidding, extension in lives) are in article 4.4 of the Sales Conditions.

Every bid placed is a firm, final and irrevocable commitment to pay by the bidder once the auction is won. The bidder may not withdraw their participation or contest the award, except for an obvious technical error by the platform. This principle does not deprive the consumer buyer of the right of withdrawal that applies to sales by professional sellers (article 13).

11.2 Drop

In a Drop, the price drops automatically between a starting price and a floor price; the first buyer to click Buy wins the item at the displayed price.

11.3 Giveaway

The giveaway is a free prize draw, subject to the rules in annex 3.

11.4 Payment deadline and strike

Every won auction must be paid for within 4 days. Otherwise, the item is put back on sale and a strike is added to the buyer’s account. A strike limits their auctions (standard and silent) to their wallet balance for 6 months; the balance must cover the bid, the buyer protection fee and delivery. Their card purchases (instant buy, Drop) remain possible. The strike expires automatically after 6 months.

The strike is applied automatically; the buyer can contest it under article 18. In case of repeated or serious breaches, Blisterr may also take the measures set out in article 24.

12. Payment through Blisterr only

Every transaction initiated through Blisterr (peek, live, auction, instant buy, messaging) must be completed exclusively through the payment methods built into the platform (bank card, Apple Pay, Google Pay, Blisterr wallet).

The following are strictly prohibited:

  • redirecting a buyer or a seller to an external payment method (direct bank transfer, PayPal, cash, cryptocurrencies, external Stripe link, etc.);
  • any proposal, attempt or suggestion to complete the sale off the platform;
  • exchanging bank details, IBANs, phone numbers or addresses in order to bypass Blisterr payment;
  • sharing a cart or a payment link with a third party in order to avoid fees or the buyer protection programme.

This rule protects sellers and buyers: only payments made through Blisterr qualify for buyer protection. Any violation may lead to account suspension.

Abusive or fraudulent chargebacks (an unjustified bank dispute when the item was received as described) may also lead to account suspension and to recovery action by Blisterr.

13. Right of withdrawal (consumer buyers)

The 14-day right of withdrawal applies when the seller is a professional and the buyer is a consumer, including for auctions and lives; it does not apply to sales between private individuals, for which a won auction is a firm commitment. The conditions, the procedure (which goes through Blisterr’s customer service), the exceptions and the refund method are set out in article 8 of the Sales Conditions, which also contain the model withdrawal form.

14. Ratings and reviews

After a delivered order, the buyer can rate the shop: item quality, packaging, delivery and communication. The overall rating (from 1 to 5) is the rounded average of these four criteria; the buyer can add a text, to which the seller can reply.

The seller can rate the buyer: communication, payment speed and overall satisfaction, with a comment.

Ratings are publicly visible on profiles. Only users who took part in a delivered order can publish a review: this is the only check carried out, and Blisterr does not verify the accuracy of their content. The text of reviews is subject to moderation (article 18). A review that is suspect or contrary to the law or to the Code of Ethics can be reported using the procedure in article 17; it may then be hidden or removed.

15. How the platform works: listing, ranking and personalisation

This section is published pursuant to articles L.111-7 and D.111-6 and D.111-7 of the French Consumer Code and article 5 of Regulation (EU) 2019/1150.

Listing and delisting. Peeks, lives, shops and items that comply with the Terms, the Sales Conditions and the Code of Ethics are listed automatically in the feed, in search and on category pages. They are delisted when sold or expired, when they are illegal or contrary to the Code of Ethics, or when the shop is suspended. From three distinct reports, an item may be unpublished automatically (unless a transaction is in progress) and a comment hidden, pending review by the team.

Default feed ranking. The peek feed is made up of five blocks: auctions ending soon, new items from the last 7 days, personalised selection, trending and discovery. Trending items are ranked by their popularity (bids, views, likes, purchases, cart additions and comments) and how new they are. To diversify the feed, the number of items from the same shop on a page is capped.

Personalisation. The personalised selection relies on a taste profile built from your interactions (views, likes, bids, purchases); items you hide or mark “not interested” are excluded. This automated processing is described in the Privacy Policy; you can object to it by writing to privacy@blisterr.com.

Search and sorting. By default, search results are ranked by a score that combines several criteria. The first is relevance to your query (text and semantic matching). Next, with a lower weight, come the item’s popularity, the click-through rate of the result, how new it is, its purchase conversion rate and its availability. For a signed-in user, part of the score takes their taste profile into account. Items you have already seen are ranked lower, and the number of items from the same shop per page is capped. You can also sort by novelty, price, popularity, ending soon or number of bids.

No remuneration influencing ranking. As of the effective date of these Terms, no remuneration paid to Blisterr, and no contractual or capital link with a seller, influences ranking or listing: Blisterr offers no sponsored content or paid promotion. Any change will be indicated in this section and on the content concerned.

16. Seller status, civil and tax rights and obligations

Seller status. Each seller is either a private individual or a professional. The status is declared by the seller in their application. A professional seller is identified as such on the public page of their shop (“Pro” badge, explained as “Professional seller” on hover or tap); a shop without this label is run by a private seller. The professional seller must give the buyer their legal information (identity, address, SIRET) before the contract is concluded. Applications are reviewed manually by Blisterr; this review does not guarantee the quality of items.

Civil rights and obligations.

  • Professional seller: provides the consumer buyer with pre-contractual information, complies with the 14-day right of withdrawal, the statutory warranties of conformity and against hidden defects and the obligation to deliver, and issues invoices. They must offer their consumer customers a consumer mediator.
  • Private seller: no right of withdrawal applies to the buyer; the warranty against hidden defects (articles 1641 et seq. of the French Civil Code) and Blisterr buyer protection apply.

Tax obligations. Taxes depend on your situation: occasional sale of personal items or regular activity. Check impots.gouv.fr or ask an accountant. Like any platform, Blisterr is required to report certain information about active sellers to the tax authorities (EU DAC7 directive, article 242 bis of the French General Tax Code). Blisterr collects seller identification information (including date of birth and, optionally, a tax identification number) that may be used for these obligations. Blisterr does not provide tax advice.

17. Messaging, reports and illegal content

Internal messaging allows exchanges related to sales. Each user chooses who can write to them (everyone, people they follow, no one).

Reporting illegal content (article 16 DSA). Anyone, with or without an account, can report content they consider illegal to Blisterr by any of the following means:

The report must include an explanation of why the content is considered illegal, the exact location of the content (URL or identifier), your name and email address (except for the most serious offences) and a statement that you are acting in good faith. For a report sent through the contact form or by email, Blisterr acknowledges receipt, examines it diligently and informs you of the outcome, as well as of the available remedies.

Single point of contact (articles 11 and 12 DSA). The authorities, the European Commission, the European Board for Digital Services and users can reach Blisterr at support@blisterr.com, in French or English.

18. Moderation, decisions and remedies

Moderation. Listings, comments, private messages, reviews and live chat messages are automatically analysed by artificial intelligence tools as soon as they are published; reported or suspicious content is reviewed by the Blisterr team. The automated analysis covers text: images and videos are reviewed by the team when reported. The use of a third-party provider for this analysis is described in the Privacy Policy.

Automatic measures. Some measures are applied automatically: the strike for non-payment of a won auction (article 11.4), the unpublishing of an item or the hiding of a comment from three distinct reports, and the hiding of content detected by the automated analysis. They can be contested under the conditions below and are then re-examined by a member of the team.

Decisions and statement of reasons (article 17 DSA). When Blisterr removes or disables access to content, restricts its visibility, restricts a payment, or suspends or closes an account, it informs the person concerned by email, stating the nature of the decision, the facts and circumstances that led to it, whether the detection and the decision were automated, the legal or contractual ground relied on and the available remedies.

Internal appeal (article 20 DSA). The person concerned can contest the decision within six months by writing to support@blisterr.com with any useful supporting documents. A member of the team re-examines the situation and replies with a reasoned decision.

Other remedies. The person concerned keeps the right to go to the competent court and, where applicable, to a DSA-certified out-of-court dispute settlement body.

19. Rules of conduct

The User undertakes to:

  • comply with the Code of Ethics;
  • not misuse the service for external commercial purposes;
  • not publish illegal, defamatory, hateful or misleading content;
  • not impersonate others;
  • not circumvent Blisterr’s payment mechanisms (article 12);
  • not initiate abusive or fraudulent chargebacks;
  • not create multiple accounts to circumvent a suspension or buyer protection;
  • not manipulate reviews, ratings or content visibility by artificial means;
  • not make a giveaway conditional on a purchase.

Any breach may lead to the measures in article 24.

20. Specific terms for professional sellers

Professional sellers are “business users” within the meaning of Regulation (EU) 2019/1150. The following provisions apply to them.

  • Changes to terms (article 3 of Regulation 2019/1150). Any change to the Terms, the Sales Conditions or the fee schedule is notified by email or in the App at least 15 days before it takes effect. During this period, the seller may terminate free of charge and without penalty.
  • Restriction, suspension and termination (article 4). Blisterr may restrict or suspend a shop or terminate a professional seller’s account for fraud or attempted fraud, illegal or misleading content, circumvention of payment through Blisterr, serious or repeated breaches of the Terms, the Sales Conditions or the Code of Ethics, or a risk to platform security. The decision is reasoned (facts, circumstances and grounds) and notified by email no later than when it takes effect. Except for serious grounds, termination is preceded by 30 days’ notice.
  • Contesting decisions and complaints (article 11). The seller can contest any decision and send any complaint by writing to support@blisterr.com (article 18); Blisterr replies with a reasoned answer.
  • Ranking (article 5). The main ranking parameters are described in article 15.
  • Differentiated treatment (article 7). As of the effective date of these Terms, a single pricing plan applies to all sellers: Blisterr grants no pricing or visibility advantage to certain sellers.
  • Data (article 9). The seller can access data on their own sales from their seller area. Buyers’ personal data is shared with them only to the extent necessary to fulfil the order (delivery, invoicing).
  • Traceability of professional sellers (article 30 DSA). During the application, Blisterr collects the professional seller’s identification information: identity, contact details, SIRET number and registration, VAT regime, identity verification and payment account via Stripe. It endeavours to check its reliability, keeps it for the duration of the relationship and then for as long as legal obligations require, and the seller undertakes to keep it up to date.
  • Obligations of the professional seller. The seller displays their legal notices, provides pre-contractual information, honours the rights of withdrawal and statutory warranties, issues their invoices (Blisterr may issue them in their name under the invoicing mandate accepted at application) and has their own consumer mediator.

21. Intellectual property

All Blisterr elements (interface, design, software, trademarks, databases) are protected by intellectual property law and belong exclusively to Blisterr.

The User grants Blisterr a non-exclusive, free licence to host and distribute their content for the technical operation of the platform.

No unauthorised reproduction, copying or exploitation is permitted.

22. Liability

Blisterr acts as a technical intermediary.

Its liability cannot be incurred for the faults of the seller, the buyer, the carriers or the payment provider, or for any case of force majeure.

Blisterr is liable for direct damage resulting from its own breaches. Nothing in these Terms limits its liability in case of personal injury, gross negligence or wilful misconduct, or deprives the consumer of the rights granted by mandatory provisions of law.

23. Personal data

Use of the Site/App involves the processing of personal data.

This processing is detailed in the Privacy Policy, accessible from the App or https://blisterr.com.

Card payments are processed by Stripe; Blisterr stores no banking data. Platform data is hosted in France (OVH). Lives are streamed from temporary servers hosted in Germany (Hetzner).

24. Suspension and termination

In case of breach of the Terms, the Sales Conditions or the Code of Ethics, Blisterr may, proportionately to the seriousness of the breach: remove content, restrict certain features or payment methods, suspend access to all or part of the Services, then terminate the account, after 15 days’ notice (30 days for professional sellers, article 20) except for serious grounds, in particular:

  • fraud or attempted fraud;
  • repeated or fraudulent non-payment of won auctions;
  • publication of illegal or misleading content;
  • a threat to platform security.

In all cases, the decision is reasoned and can be contested under article 18 (and article 20 for professional sellers). The user can close their account at any time.

25. Assignment

The User may not assign this contract without Blisterr’s consent.

Blisterr may transfer the contract to a company taking over the platform’s business, informing the User beforehand. If the transfer affects their rights, the User may close their account free of charge.

26. Force majeure

No party can be held liable for an unforeseeable, irresistible and external event (force majeure) making performance of the contract impossible.

27. Evidence

Electronic records, histories and connection logs produced by Blisterr are authoritative between the parties, unless proven otherwise.

28. Consumer mediation and complaint handling

Complaints are handled by the Blisterr team (article 18 and article 10 of the Sales Conditions). In accordance with articles L.611-1 et seq. of the French Consumer Code, every consumer may use a consumer mediator, free of charge, for a dispute with Blisterr, after a prior written complaint.

29. Governing law and jurisdiction

These Terms are governed by French law, without depriving the consumer of the protection afforded by the mandatory provisions of their country of habitual residence.

The consumer may bring proceedings, at their choice, before the courts of the place where they live or any other competent court. For disputes between professionals, the courts of Bayonne have jurisdiction.

30. Language

These Terms are written in French. The English translation is provided for information only; the French version is the only authoritative one.


Annex 1: Fees and payments

  • Buyers: buyer protection fee of 6.9% of the item price (shipping excluded) + €0.49 once per order with the same seller, and only once for a whole live session. Example: a €50 item → €3.45 + €0.49 = €3.94, i.e. €53.94 before shipping. No fee for a giveaway.
  • Sellers: 0% commission, no listing fees.
  • Seller withdrawals: 1 free every 40 days; then 3% + €1 per withdrawal. Minimum €1 per withdrawal.
  • Buyer withdrawals: free of charge, to the original payment method, for amounts paid by card and not used.
  • Payment of a sale: no later than 20 days after delivery.
  • Payments: by card via Stripe (no banking data stored by Blisterr) or by wallet. The wallet cannot be topped up; it is not subject to any inactivity or account-keeping fees.
  • Payment of a won auction: within 4 days.

Annex 2: Referral programme rules

Organiser. BLISTERR SAS (contact details at the end of the document).

Rewards.

  • The referrer receives €5 credited to their wallet, not withdrawable, once the referee’s first order of at least €20 is validated.
  • The referee receives a €5 discount code valid for 30 days, usable on a first order of at least €20. They do not receive a wallet credit.

How to take part. The referee must have activated their referrer’s code before their first order, by opening the invitation link and then logging in, or by entering it in the app (Referral, “Activate my code”). They then use their discount code at payment.

Conditions. The referee must never have placed an order. Self-referral is prohibited. A referee has only one referrer. A referrer can refer at most 20 people per rolling 30-day period and 100 people in total.

Funding. The referee’s discount and the referrer’s credit are funded by Blisterr; they are never taken from the seller’s share.

Fraud. Blisterr may refuse or cancel the benefits and suspend the accounts concerned in case of fraud or abuse (self-referral, multiple accounts, circumvention of the conditions).

Duration and changes. The programme has no fixed duration. Blisterr may change or end it, with 15 days’ notice published on this page; referrals already registered before the effective date keep the benefits provided for.

Data. The invitation page shows the referrer’s username. Data processing is described in the Privacy Policy.

Annex 3: Giveaway rules

Organiser. The giveaway is organised by the seller who publishes it on their shop and provides the prize. Blisterr only provides the technical tool for the draw and is not the organiser.

Free of charge and no purchase necessary. Participation is free: no entry fee is charged, and the winner pays neither the item, nor the buyer protection fee, nor delivery, which is borne by the seller. No purchase is required to take part in a giveaway open to everyone. When the seller limits it to their followers or past buyers, the condition relates to the existing relationship with the shop; making a giveaway conditional on a purchase is prohibited (article 19).

Participants. The seller chooses the audience: everyone, their shop’s followers, or their past buyers. You need a Blisterr account and must be eligible for the chosen audience.

Draw. The winner is selected by random draw among eligible participants when the giveaway closes. Only the Blisterr team can redo or force a draw in case of an anomaly; the seller cannot.

Prize. The prize is described in the seller’s giveaway announcement, and the seller ships it to the winner.

Rules. These rules are available free of charge at any time on this page; a copy can be requested at support@blisterr.com. Taking part implies acceptance of the rules. The giveaway is organised in accordance with article L.121-20 of the French Consumer Code.
